Model Release & Contract


RETAINER AND PAYMENT

  1. Retainer & Reservation
    The Client agrees that the paid retainer is non-refundable and non-transferable as it compensates Shante London Photography for reserving the session date and potential loss of other bookings. The session is not confirmed until the retainer has been paid in full.

  2. Rescheduling & Cancellations

    • If the Client requests to reschedule, one reschedule is permitted for unforeseen circumstances (e.g., illness, weather for outdoor shoots) at the photographer’s discretion. The rescheduled session must occur within [30] days of the original date, subject to availability.

    • Additional reschedules or any change of date beyond the one-time allowance require a new contract and retainer and will be subject to current pricing.

    • If the Client cancels the session entirely, all retainers and payments made are forfeited and cannot be credited toward future sessions or products.

  3. Final Payment & Non-Sufficient Funds (NSF)

    • All remaining balances must be paid in full by the due date specified in this contract. If any payment is returned due to Non-Sufficient Funds (NSF) or a declined transaction, the Client agrees to pay a $60 Service Fee in addition to the outstanding balance.

    • Images will not be edited or delivered until all payments, including fees, are cleared. If final payment is not received within seven [7] days before the session date, the session may be considered forfeited without refund.

  4. Pricing & Additional Purchases

    • Pricing is only guaranteed for the services and products selected at the time of contract signing. Any additional purchases made after signing are subject to current pricing at the time of request, which may change without notice.

    • Verbal agreements do not override the terms of this contract. Any modifications must be made in writing and signed by both parties.

BALANCE AND LATE FEE

  1. Final Payment

    • The Client agrees to pay the full remaining balance no later than seven (7) days prior to the scheduled session date, unless a written payment plan has been arranged.

    • If the balance is not paid in full by this deadline, the session will not take place, and the reservation may be forfeited without refund.

  2. Late Payment & Fees

    • If payment is not received by the due date, a 10% late fee (calculated based on the total collection amount) will be added to the outstanding balance.

    • If payment remains unpaid seven [7] days after the due date, Shante London Photography reserves the right to cancel the session, and all retainers and prior payments will be forfeited.

  3. Payment Plans (If Applicable)

    • Clients on an approved payment plan must adhere to the agreed-upon schedule. Any missed payments will result in a late fee and may delay the session or delivery of images until the balance is cleared.

CANCELLATION

  1. Client Cancellations & No-Shows

    • If the Client cancels without rescheduling or fails to appear for the session, a $100 cancellation fee will be due immediately upon cancellation.

    • All previously paid retainers and payments will be forfeited and cannot be credited toward future sessions or products.

  2. Rescheduling & New Booking

    • If the Client wishes to schedule a new session after cancellation, a new retainer of $250 will be required to secure a new date.

    • Rescheduling is subject to the photographer’s availability and current pricing at the time of rebooking.

RESCHEDULING & LATE ARRIVALS

  1. Rescheduling Requests

    • If the Client requests to reschedule, all payments will be applied to a new session only if notice is given at least three (3) days before the scheduled session date.

    • If the Client requests to reschedule within three (3) days or less of the scheduled session, the full retainer is forfeited. A $250 rescheduling fee will be due on the day of the newly scheduled session.

    • Special consideration may be made for last-minute reschedules due to emergencies at the photographer’s discretion.

  2. Rescheduling Limitations

    • The rescheduled session must occur within 30 days of the original date or the earliest available date on Shante London Photography’s calendar.

    • More than one reschedule will result in the forfeiture of the current retainer, and a new retainer of $250 will be required to book another date.

  3. Late Arrivals & Session Delays

    • A $25 late fee will be charged for every 15 minutes of delay past the scheduled start time. This fee must be paid in cash before the Client leaves the session.

    • If the Client is late, that time is deducted from the scheduled session duration. The photographer is not responsible for unfinished looks, missed shots, or lower photo quantity due to Client tardiness.

    • If the Client is more than 30 minutes late, the session is considered canceled and will require a new retainer to reschedule.

  4. Photographer’s Right to Refuse Service

    • If the Client does not allow sufficient time for the session, Shante London Photography reserves the right to decline to proceed with the session. The Client understands that failure to provide adequate time may result in fewer images or incomplete obligations as outlined in this contract, without refund or compensation.

IMAGE REVEALS

  1. Scheduling & Timeline

    • The Client must schedule their Image Reveal within fourteen (14) days of the photographer letting client know their image reveal is ready to view. Failure to do so may result in the forfeiture of images at the photographer’s discretion.

  2. Order & Payment Terms

    • A minimum first payment of $100 is due on the day of the Image Reveal.

    • The Image Reveal is the only opportunity for the Client to place product orders. Additional orders outside of this session are not guaranteed and will be subject to the photographer’s availability.

    • All products must be paid in full before they are ordered from the lab. The Client is responsible for arranging pick-up of all purchased items.

  3. Late Payments

    • If the Client is on a product payment plan, any missed payments will be subject to a $5 per day late fee until the balance is paid in full.

  4. Cancellations & Rescheduling

    • If the Client cancels or fails to attend the Image Reveal without rescheduling, a $200 cancellation fee will be due immediately.

    • A new Image Reveal can be scheduled once the cancellation fee has been paid in full.

    • If the Client wishes to reschedule, at least three (3) days’ notice is required to avoid the cancellation fee.

PHOTOGRAPHIC PROOFS

  1. Image Reveal Scheduling

    • The Photographer will schedule the Client’s Image Reveal within 1 to 12 weeks of the session date, depending on workload and editing timelines.

    • Once the Client is notified that their gallery is ready for viewing, they must schedule the Image Reveal within fourteen (14) days of notification.

  2. Archival & Reactivation Fees

    • If the Client fails to schedule the Image Reveal within one (1) month of notification, their gallery will be archived. A $300 un-archival fee will be required to reopen the gallery.

    • If the Client attends the Image Reveal but does not place a minimum first payment of $100, all images will be archived immediately. A $300 un-archival fee will be required to access the gallery again.

ALBUM LAYOUT

  1. Album Design

    • The client agrees that all album layouts are designed by the photographer.

SATISFACTION OF IMAGES

  1. Client Satisfaction & Selection

    • The Client acknowledges satisfaction with their images by selecting and purchasing images at the Image Reveal.

    • If the Client is dissatisfied with the final images, they must express their concerns immediately during the Image Reveal—concerns raised after the Image Reveal will not be considered.

  2. Re-Shoot Policy

    • The Photographer, at their sole discretion, will determine if a re-shoot is appropriate. A re-shoot is not guaranteed and will only be considered in cases of technical issues or extreme dissatisfaction.

    • If a re-shoot is granted, the following conditions apply:

      • The new session must be scheduled within 30 days of the original Image Reveal.

      • All images from the original session will be permanently destroyed and will no longer be available for purchase.

      • The Client is responsible for all Hair and Makeup costs for the new session.

COMPLETION SCHEDULE

  1. Product Delivery Timeline

    • The completion schedule and delivery of products will be determined from the date of final approval by the Client.

    • Products typically require one (1) month from the date of final design approval to be received by the Photographer.

    • Third-party manufacturing laboratories are used for product fulfillment, and their policies or restrictions may affect production timelines.

  2. Rush Orders & Expedited Fees

    • If the Client requires a faster turnaround, they must notify the Photographer at the time of order placement.

    • An expedited fee of $250.00 will be applied to all rush editing or product requests.

  3. Liability for Delays

    • The Photographer is not responsible for any delays caused by third-party manufacturers, shipping carriers, or unforeseen circumstances outside their control.

    • Clients are advised to place orders with sufficient time to accommodate potential delays.

PRODUCT PICKUP

  1. Pickup Deadline & Forfeiture

    • The Client agrees to pick up all ordered products within two (2) weeks of notification that they are ready.

    • If products are not picked up within this timeframe, the Client forfeits all payments made, and the products will be considered void.

  2. Extended Storage & Fees

    • Products will be held for an additional three (3) months beyond the initial pickup period.

    • A $100 storage fee per month will be required for late pickups. This fee must be paid in full before the Client can receive their products.

SHIPPING & DELIVERY

  1. Shipping Fees

    • The Client agrees that a shipping fee will apply if they request products/items to be shipped.

    • This fee will be assessed for each individual shipment and will be due in full before the items are shipped.

    • The cost of shipping will be calculated based on the size, weight, and destination of the item(s) being shipped.

ARTISTIC RIGHTS

  1. Selection of Photographic Proofs

    • The Photographer retains full discretion in selecting the photographic proofs presented to the Client.

    • The Client will receive a gallery of 1 or more photographs, depending on the package selected, from which to choose the final edited images. The Client will not receive any images outside of the selected proofs presented in the gallery.

  2. Post-Processing & Adjustments

    • The Photographer has the exclusive right to make adjustments to the photographs during post-processing as they see fit, in accordance with their creative vision.

    • The photographic proofs are considered final once presented, and any additional edits or modifications requested by the Client after the final images have been delivered will incur a $50 per image fee.

  3. Artistic License

    • The Photographer retains full artistic license in relation to all photographs taken during the session. This includes, but is not limited to, composition, editing style, and presentation.

CREATIVE CONTROL

  1. Creative Direction of the Session

    • The Photographer retains full creative control over the session, including but not limited to adjustments of hair, makeup, jewelry, clothing, props, and sets.

    • The Client understands that Shante London Photography is not responsible for providing clothing in a specific color, style, or size that has been seen on social media platforms or elsewhere.

  2. Use of Photographer’s Collection

    • Items from THE PHOTOGRAPHER’S collection are use at your own discretion and are subject to limited availability in terms of size, shape, color, and style. The Client should be aware that not all items may be available in their preferred style or size.

  3. Physical Requirements

    • The Client understands that a Shante London Photography session may involve certain physical movement or activity.

    • The Client agrees not to book a session if they are unable to follow simple movement requests or if they are injured.

    • If the Client has any questions or concerns regarding the physical requirements, they must discuss them with the Photographer before booking to ensure understanding and clarity.

PHOTOGRAPHIC MATERIALS

  1. Ownership of Photographic Materials

    • All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, are the exclusive property of Shante London Tomes and Shante London Photography.

    • Orders must be placed within the specified schedules outlined in this agreement.

    • No products, including digital files, will be released until the total sales order is paid in full as per the payment schedule outlined in this agreement.

COPYRIGHT AND REPRODUCTIONS

  1. Photographer’s Copyright

    • Shante London Tomes and Shante London Photography shall own the copyright to all images created during the session.

    • The Photographer retains the exclusive right to reproduce the images for purposes including but not limited to:

      • Marketing materials

      • Portfolio entries

      • Sample products

      • Editorial submissions

      • Display on the Photographer’s website or studio

  2. Model Release

    • If the Client signs a Model Release, the Photographer may use the images for the purposes outlined above.

    • If the Client declines to sign the Model Release, the images will not be used publicly outside of the studio or on the internet.

    • The Photographer retains the right to use the images for studio purposes regardless of the Model Release status.

CLIENT USAGE

  1. Permitted Use of Photographs

    • The Client agrees to use the photographic prints and digital files only for personal use, as outlined in this agreement.

    • The Client may not submit the images to contests, or use them for commercial or non-commercial purposes without the express written permission of the Photographer.

  2. Restrictions on Reproductions

    • The Client may not authorize reproductions by non-purchasers unless explicitly covered by the terms of this agreement.

    • If the Photographer provides a digital file print release, the Client must follow the terms outlined in the release.

SOCIAL MEDIA

  1. Sharing of Photographs

    • The Client may share web/blog posts, links, and social media albums using the share functions and by disseminating direct links.

    • The Client shall not copy, download, screenshot, or capture the photographs in any other way.

    • When sharing images on social media, the Client agrees to identify "Shante London Photography" in the caption of all photographs uploaded.

    • When uploading images to Facebook, the Client must tag the Photographer’s business page in the albumof the uploaded files.

    • The Client shall not edit, alter, or crop the image in any way when posting on social media.

USE OF INDEPENDENT CONTRACTOR

  1. Liability for Hair/Makeup Artist Services
    In the event that a hair and/or makeup artist is provided by the Photographer, the Photographer is not liable for any issues arising from the services rendered by the independent contractor. This includes, but is not limited to, allergic reactions caused by the products used by the independent contractor. It is the Client’s responsibility to communicate any allergies or concerns about products to the independent contractor/hair and makeup stylist before the session begins.

  2. Liability for Image Editing & Sales/Image Reveal Services
    The Photographer may also utilize independent contractors for professional image editing and sales/image reveal sessions. While these contractors operate under the direction of Shante London Photography, they are independent service providers. The Photographer is not liable for any technical issues, editing preferences, or sales consultations conducted by these contractors. All final editing decisions are made at the discretion of Shante London Photography, and any requests for additional edits or revisions may be subject to additional fees.

DISTURBANCE

  1. Right to Terminate the Contract

    • Both parties agree that this contract is conditional upon the Client fulfilling all obligations in a satisfactory manner, as deemed by Shante London Photography.

    • The Photographer reserves the right to terminate this contract and/or remove the Client from the studio or other location of the shoot at any time, without a refund, if the Client engages in illegal actions, or exhibits belligerent, inappropriate, or disruptive behavior as deemed by the Photographer.

    • The Photographer may also terminate this contract if the Client is not performing in a manner acceptable to the Photographer or if the terms of this Contract are not being met.

    • The Client agrees that any cancellations must be in writing. No monetary reimbursement will be provided, and the session will not be rescheduled.

CAMERA USE DURING SESSION

  1. Exclusive Camera Use by the Photographer

    • Shante London Photography prohibits the use of cameras or camera phones by anyone other than the hired photographer and/or the hired photographer’s employees during the session.

    • If any photos are taken during the session by anyone other than the hired photographer and/or the hired photographer’s employees, those photos must be permanently destroyed and deleted.

    • If these unauthorized photos are not destroyed and deleted, the session will be canceled, and all payments made will be forfeited.

THIRD PARTY COMMUNICATION

  1. Communication Protocol

    • Shante London Photography requires that all communication during the booking and ordering process be made directly with the Client only.

    • No communication with any third party (e.g., husband, wife, boyfriend, girlfriend, partner, friend, or family member) will be acknowledged.

    • All communication regarding emails, phone calls, or text messages will be directed to and acknowledged by the Photographer and the Client only.

FAILURE TO PERFORM

  1. Photographer’s Inability to Perform

    • If the Photographer is unable to perform the agreed-upon session due to illness, emergency, fire, casualty, strike, act of God, or other causes beyond the Photographer’s control, the Photographer and Client will make every attempt to reschedule the session.

    • The Client will not receive a refund in this case, but will instead receive full credit for a future sessionwith Shante London Photography. This credit must be used within 12 months.

    • If rescheduling is not possible, the Photographer shall return the retainer fee to the Client and shall have no further liability.

    • If the Photographer is unable to deliver photographic materials due to technological malfunctions(including but not limited to camera failure, processing errors, or loss/damage of files), the Photographer’s liability will be limited.

CLIENT COMPETENCY AND PARTICIPATION

  1. Client Eligibility

    • The Client agrees that they are of legal age to participate in a Shante London Photography Session and an In-Person Image Reveal, both held at the designated location assigned by Shante London Photography.

INDEMNIFICATION

  1. Liability for Injury

    • The Client agrees to hold harmless the Photographer for any injury that may occur during the photography session and any surrounding events.

    • The Photographer, their equipment, and studio shall not be held liable for any injury that occurs on the premises during the session.

    • The Photographer is also not responsible for injuries to anyone else present at the session, including children, caregivers, family members, friends, or any other individuals in attendance.

 

 

MODEL RELEASE AGREEMENT

In consideration of my engagement as a model, and for other valuable consideration, the receipt of which is hereby acknowledged, I grant the following rights and permissions to Shante Tomes, Shante London Photography("Photographer"), including their heirs, legal representatives, assigns, and any individuals or entities acting under their authority or permission.

1. Grant of Rights

I irrevocably and perpetually grant Shante London Photography the unrestricted right and permission to:

  • Photograph, use, re-use, publish, and republish images of me, whether in whole, in part, or in composite form.

  • Alter, modify, or digitally composite the images without restriction as to color, size, shape, perspective, context, foreground, or background.

  • Use my likeness in connection with any name (real or fictitious) and in any medium, including but not limited to print, online, social media, advertising, editorial, trade, and promotional use.

2. Waiver of Inspection and Approval

I waive any right to inspect, approve, or request modifications to:

  • The final images, edits, or any derivative works.

  • Any accompanying advertising copy, editorial content, or promotional material.

3. Release of Liability

I release, discharge, and hold harmless the Photographer and all associated parties from any claims, liabilities, or damages arising from:

  • The use, alteration, or distortion of the images.

  • Any blurring, retouching, optical illusions, or artistic modifications, whether intentional or unintentional.

  • Any claims related to defamation, libel, privacy rights, or publicity rights.

4. Age and Legal Capacity

I confirm that:

  • I am of legal age and have the full right and authority to enter into this agreement.

  • This release is binding upon myself, my heirs, legal representatives, and assigns.

I have read, understood, and voluntarily agreed to the terms of this Model Release.
